By placing an order and/or downloading a report, you confirm that you have read, understood, and agree to be bound by these Terms.
EnviroTech UK ("we", "us", "our") operates an automated environmental desktop study platform that generates reports using publicly available datasets. We are not a regulated environmental consultancy and do not provide professional environmental advice.
Our Reports are Environmental Desktop Studies compiled exclusively from publicly available datasets. They are not equivalent to, and should not be treated as, any of the following:

They are intended to assist in the early-stage identification of potential environmental constraints and should not be relied upon as the sole basis for any planning application, development decision, financial transaction, property purchase, or other consequential action.
Desktop data cannot replicate the findings of a physical site investigation. Conditions on the ground may differ materially from those indicated by publicly available datasets. We strongly recommend that you commission appropriate site-specific surveys and investigations from suitably qualified and regulated professionals before making any decisions in reliance on our Reports. Depending on the findings of this Report, this may include but is not limited to an ecologist, archaeologist, geotechnical engineer, hydrogeologist, or contaminated land specialist.
Our Reports are generated using datasets that may not reflect the most current environmental conditions, designations, or regulatory requirements. Public datasets are updated at varying intervals; records may be incomplete, outdated, or subject to change. The absence of a recorded feature in our Report does not guarantee that the feature does not exist on or near the site.
To the maximum extent permitted by applicable law, our total aggregate liability to you in connection with any Report or service — whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the amount paid by you for the Report giving rise to the claim.

We accept no liability for errors, omissions, or inaccuracies in Third-Party Data Sources. The accuracy and completeness of our Reports is dependent on the accuracy of the underlying datasets, which are maintained by third parties over whom we have no control.
The information contained in our Reports does not constitute professional environmental, planning, legal, financial, or geotechnical advice. It should not be treated as a substitute for advice from a suitably qualified and regulated professional.
It is your responsibility to ensure that any development or activity carried out in reliance on or informed by our Report complies with all applicable legislation, planning policy, and regulatory requirements, including but not limited to the requirements of NatureScot, Historic Environment Scotland, the Scottish Environment Protection Agency (SEPA), local planning authorities, and the Coal Authority (Mining Remediation Authority).
The price for each Report is as stated on the website at the time of purchase and is inclusive of VAT where applicable. We reserve the right to amend pricing at any time without notice, though any change will not affect orders already placed.
Payment is processed securely via Stripe. We do not store your card details. Your payment is taken at the time of purchase.
Your Report will be delivered electronically to the email address provided at checkout following confirmation of payment. Delivery is typically within minutes of payment confirmation. We accept no responsibility for non-receipt of Reports due to incorrect email addresses, spam filters, or email provider issues. If you have not received your Report within one hour of payment, please contact us at info@envirotechuk.com.
Under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, you have the right to cancel a digital content purchase within 14 days, unless you have expressly requested that the digital content be provided before the expiry of the cancellation period. By completing your purchase and requesting immediate delivery of your Report, you expressly consent to the supply of the digital content beginning immediately, and you acknowledge that you will lose your right to cancel once the Report has been generated and delivered. This does not affect your statutory rights where a Report is defective.
The Report is generated by our platform using publicly available datasets. We retain all intellectual property rights in the software, templates, and format of the Report. The underlying data is owned by the respective Third-Party Data Sources.
Upon payment and delivery of your Report, we grant you a non-exclusive, non-transferable licence to use the Report for your own internal purposes. You may share the Report with your professional advisers, planning consultants, or other parties directly involved in the project to which the Report relates.
You must not resell, republish, or commercially exploit the Report or any part of it without our prior written consent.
We collect and process your personal data (including your name and email address) in accordance with our Privacy Policy, which is available on our website. Your data will be used to deliver your Report, manage your account, and (where you have consented) to send you relevant communications. We will not sell your personal data to third parties. You agree not to use our platform or Reports for any unlawful purpose, to misrepresent the nature of the Reports to third parties (including representing them as equivalent to a professional site investigation), or to use the Reports in a manner that could bring EnviroTech UK into disrepute.
We reserve the right to amend these Terms at any time. Changes will be posted on our website and will take effect from the date of posting. Your continued use of the platform following any amendment constitutes your acceptance of the revised Terms. The Terms in force at the time of your purchase will apply to that purchase.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Scotland. The courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim, though we retain the right to bring proceedings in the courts of any jurisdiction in which you are domiciled.
